Terms of Use

The short version.

1. Agreement

These terms are an agreement between you and Rufus (“we”, “us”) covering your use of the AperFolio iOS application (“the app”). By downloading or using the app you accept them. If you do not accept them, do not use the app.

Your use of the app is also subject to the Apple Media Services Terms and Conditions, including the Usage Rules in them.

2. Licence

We grant you a personal, non-transferable, non-exclusive licence to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app is licensed, not sold, and we retain all rights not expressly granted.

3. What the app does

AperFolio reads the EXIF metadata in photographs in your library, matches each frame to the camera and lens that made it, and presents what it finds. It is a tool for looking at your own work. It is not a photo editor, not a backup service, and not a substitute for keeping your own copies of your files.

4. Your content

Your photographs, and the titles, stories and locations you write in the app, are yours. We claim no ownership of them and no licence to them. We never receive them: they are stored only on your device. See the Privacy Policy for detail.

Because everything is stored locally and we hold no copy, you are responsible for your own backups. Deleting the app deletes what it has stored, including anything you wrote in it.

5. Subscriptions and purchases

What is free

The sample collection is free and needs no subscription. It is a generated archive — not your photographs — and it exists so you can see what the app does before deciding whether to pay for it. It is for browsing: importing, editing, organising, personalising and sharing are part of a subscription. Once you subscribe, the sample is replaced by your own collection.

What a subscription buys

Importing your own photo library, and seeing the collection built from it. There are three ways to pay:

Prices are shown in the app in your local currency and are set in App Store Connect; the price displayed at the moment of purchase is the price that applies. We never write a price into the app itself.

Renewal and cancellation

What happens when a subscription ends

Nothing is deleted. Your collection stops being shown and is not removed: every frame record, title, story and corrected location stays on your device exactly as you left it, and subscribing again brings all of it straight back. Your photographs themselves are never touched at any point — they live in your photo library, not in this app.

The sample collection remains available whether or not you have a subscription.

Refunds

All purchases are processed by Apple. Refunds are handled by Apple under the Apple Media Services Terms and Conditions, and we cannot issue them. Request one at reportaproblem.apple.com.

6. Acceptable use

Use the app only with photographs you own or are otherwise entitled to use, and only in a way that complies with the law where you are.

7. Accuracy

Every number, chart and statement in AperFolio is computed on your device from the metadata in your own files. Metadata is frequently incomplete, and some cameras and lenses report themselves inconsistently or not at all. Where the app is uncertain about a match, it says so and asks you. Figures are offered as an honest reading of what your files contain, not as a guarantee of fact, and should not be relied on for insurance, valuation, warranty, or any other purpose where being wrong would cost you something.

8. Disclaimer of warranties

To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or future version of iOS.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any statutory consumer right you have that cannot lawfully be limited.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or exemplary damages, or for loss of data, loss of profits, or loss of goodwill, arising out of your use of or inability to use the app. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim arose.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

10. Changes

We may update the app and these terms. When the terms change materially, the date at the top of this page changes and the change is noted in the App Store release notes. Continuing to use the app after that means you accept the updated terms. If you do not, stop using the app.

11. Termination

This licence lasts until terminated. It ends automatically if you breach these terms, and you may end it at any time by deleting the app. Sections 4, 7, 8, 9 and 12 survive termination.

12. Governing law

These terms are governed by the laws of the mainland of the People’s Republic of China — that is, excluding for these purposes the Hong Kong and Macau Special Administrative Regions and Taiwan, which have separate legal systems — without regard to its conflict-of-laws rules. This does not deprive you of the protection of mandatory consumer law in your country of residence.
